Terms and Conditions
1. The acceptance of the booking, may it be done in this website or in Vince Sambo Photography’s affiliate links, which includes, but is not limited to FACEBOOK, GOOGLE, INSTAGRAM, WHATSAPP and or through EMAIL, is based on the agreement by the client of the terms and conditions stated herein.
2. PAYMENT: A non-refundable reservation fee of Php500 will be collected at the time of booking to secure your session date. Full payment should be made on the day of the scheduled photo session. No pencil-booking except for newborn session. Vince Sambo Photography retain the right to cancel or reschedule unpaid reservations to cater paying clients. For newborn sessions only: Due to the uncertain prediction of an exact arrival day of your baby, certain flexibility for booking the newborn session will apply. An initial date within the first 10 days of your due date is to be pencil-booked in, however, this is subject to change depending on the exact date of birth.
Once agreed upon a final session date, the client has the right to reschedule the session only once if required, which will be subject to availability. After this a Php500 rebooking fee will be charged. If the photoshoot needs to be cancelled due to unforeseen reasons, session fees are refundable 10 days before your session date, after this time it becomes non-refundable but transferable once (should you wish to change the date).
3. TRAVEL: The travel cost within a radius of 10 kilometers from Vince Sambo Photography is included in all price packages. Additional distances will incur a transportation surcharge and will be measured based on Grab’s charges, rounded to the nearest hundred multiplied by 2 (back and forth).
4. SICKNESS: We understand that children can be unpredictable and fall ill at any time. In the event of sickness prior to the session, the Client agrees to make every possible effort to inform Vince Sambo Photography no later than 3 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum 30-day period. Vince Sambo Photography reserves the right to re-schedule outside of this time limit due to any existing commitments. If the Client fails to reschedule within the 30-day period, Vince Sambo Photography has the right to cancel the booking with all payments made non-refundable. In the event of the child falling ill during the session, Vince Sambo Photography reserves the right to postpone the photo shoot and re-schedule at the convenience of both parties. In the event of this happening the Client agrees to incur the additional travel expenses.
4.1 SAFETY RELATED TO COVID-19: Safety is paramount in everything we do. Upon arrival at the client’s residence and prior to any photoshoot, Vince Sambo Photography shall clean and sanitize every equipment. We will then do a contact-less temperature check including the client and everyone in the household. Hand gloves and face mask is a must and shall be worn throughout the session.
5. PRINTS: All orders for albums, reprints, products and enlargements must be paid for either at time of booking (if package with album has been chosen) or at the time of ordering. Vince Sambo Photography has partnered with third party printing and delivery services and does not held liable to any delays in print production or damages made during transport or delivery.
6. DELIVERY: All high-resolution images will be delivered via a download link to the Client within 2-4 weeks of the session date. Delivery for prints, albums or any other additional orders may vary and will be advised at time of booking when final images have been delivered.
7. COPYRIGHT: It is understood that the copyright of all and any photographs belongs to Vince Sambo Photography. No photographs may be copied or reproduced by any means photographic or otherwise by any person or machine other than by the photographer or his appointed agent, unless the RAW (.NEF) pictures are purchased by the Client. Once RAW files are purchased by the client, they alone retain the copyright of the said images and Vince Sambo Photography will not use those pictures as mentioned in Section 8.
Releasing photographs online by the Client (i.e. Facebook, blog or any other online channels) are prohibited unless the photographer’s company name, Facebook Page and/or Website is tagged or mentioned along with the image.
8. MODEL RELEASE: The copyright of all photographs is owned by Vince Sambo Photography. The client, give permission to Vince Sambo Photography to use any image of our photo session for any general marketing and advertising purposes for Vince Sambo Photography. Vince Sambo Photography is entitled to use all images produced for i.e. exhibitions, editorials, digital and print marketing incl. social media platforms, publications, educational DVDs and websites, and/or display purposes. For documentation purposes, Vince Sambo Photography shall ask the client to sign a model release on the day of the photo session.
8.1. CLIENT RIGHTS: Should you, as a client, refuses to use your images for the purpose listed above, you can opt to purchase the digital RAW (.NEF) files and shall hold the sole copyright of the images bought as mentioned in Section 7.
9. STORAGE: After 12 months from your session date Vince Sambo Photography will no longer be responsible for storing your image files.
10. MISCELLANEOUS: Although the photographer shall exercise all reasonable skill, care and diligence in the discharge of his/her duties, it is understood that, in the event of any unforeseen circumstances causing loss of photographic record or even accident in any means or form, the photographer will only be held responsible for the return of all the money paid to date, although every effort will be made to re-take the photographs if possible.
